Terms & Conditions

By accessing or using the Trako platform — including the Trako Dispatch app, Trako Rider app, and the delivery.itrack.pk web dashboard (collectively, the "Service") — you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

1. Definitions

  • Platform: The Trako web dashboard, Trako Dispatch mobile app, and Trako Rider mobile app.
  • Restaurant: A business entity that uses Trako to manage delivery operations.
  • Staff: Authorized personnel of a Restaurant who access the dispatch dashboard.
  • Rider: A delivery person who uses the Trako Rider app to receive and fulfill orders.
  • Customer: An end consumer who receives a tracking link to follow their delivery.

2. Eligibility

You must be at least 18 years old to use the Service as Staff or Rider. Customer tracking links do not require an account or age verification. By creating an account, you represent that you are authorized by your Restaurant to access the platform.

3. Account responsibilities

  • Credentials: You are responsible for maintaining the confidentiality of your login credentials and device pairing codes.
  • Authorized use: You may not share accounts or allow unauthorized persons to access the platform on your behalf.
  • Accuracy: You agree to provide accurate information including delivery addresses, contact numbers, and rider details.

4. Acceptable use

You agree not to:

  • Misuse GPS: Spoof, manipulate, or falsify location data transmitted through the platform.
  • Interfere: Attempt to disrupt, reverse-engineer, or gain unauthorized access to Trako systems.
  • Violate laws: Use the Service for any purpose that violates applicable local, national, or international laws.
  • Scrape data: Use automated tools to extract data from the platform without written permission.

5. GPS and location tracking

The Trako Rider app collects GPS location data to enable real-time delivery tracking. By using the Rider app, you consent to continuous location collection while on duty. Location data is shared with the Restaurant dispatch and the Customer receiving the delivery. See our Privacy Policy for full details.

6. Service availability

We aim for high availability but do not guarantee uninterrupted service. The platform may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for losses caused by downtime.

7. Intellectual property

All content, trademarks, and software comprising the Trako platform are owned by Trako. You are granted a limited, non-exclusive license to use the Service for its intended purpose. You may not copy, modify, or distribute any part of the platform.

8. Limitation of liability

To the maximum extent permitted by law, Trako shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, delivery delays, or inaccurate GPS data. Our total liability shall not exceed the fees paid by your Restaurant in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may stop using the Service at any time. Upon termination, your right to access the platform ceases immediately. You may request deletion of your data per our data deletion policy.

10. Changes to these terms

We may revise these Terms from time to time. Material changes will be communicated via the platform or email. Continued use of the Service after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Pakistan. Any disputes shall be resolved in the courts of Karachi, Pakistan.
